TuneScript.ai ("TuneScript," "we," "us," or "our") provides AI-powered tools to create original music and songs. By accessing or using our platform, you agree to these Terms of Service ("Terms"). If you do not agree, please discontinue use of the Service.
1. Acceptance of Terms
By using TuneScript, you agree to the following:
- Comply with all applicable laws, including copyright and intellectual property laws.
- Follow these Terms and our Privacy Policy.
- Represent that you have the legal authority to accept these Terms on your behalf.
2. Definitions
"TuneScript" or "we/us" — refers to the TuneScript platform and services.
"User" or "you" — any individual accessing or using TuneScript.
"AI Content" or "Output" — music, lyrics, melodies, or other content generated by TuneScript using your prompts.
"Input" — any text, prompts, or content you provide to TuneScript to generate Output.
"End User" — guests or third parties who generate content using your account.
3. Ownership and Intellectual Property
3.1 Ownership of Input
- You retain all rights in any content you submit as Input.
3.2 Ownership of Output
- All Output generated by TuneScript, including music, lyrics, melodies, and other creative content, is owned exclusively by TuneScript or its licensors.
3.3 Limited License to Users
- TuneScript grants you a non-exclusive, non-transferable, revocable license to use the Output for personal, non-commercial purposes, unless otherwise explicitly authorized.
- TuneScript reserves the right to revoke this license at any time, for any reason.
3.4 Restrictions
You may not:
- Generate content that infringes the rights of others.
- Submit prompts asking TuneScript to copy or imitate copyrighted songs, artists, bands, or melodies.
- Use TuneScript to produce content that is illegal, obscene, defamatory, threatening, discriminatory, or harmful.
4. User Conduct and Prohibited Uses
You agree that you will not use TuneScript to:
- Violate any applicable law, including copyright and intellectual property law.
- Share or sell your account access to third parties.
- Generate content that could reasonably be considered infringing on third-party rights.
System Prompt Enforcement: TuneScript employs guardrails to prevent copying of existing copyrighted works, but you remain responsible for the legality of your generated content.
5. Public Performance of AI Content
- You may publicly perform, stream, broadcast, or play Output without paying royalties to PROs, provided that Output is original and does not infringe third-party copyright.
- TuneScript does not guarantee that all Output is free from potential copyright conflicts, and you accept all legal risk related to public performance or distribution.
6. Liability and Indemnification
6.1 Your Responsibility
- You are solely responsible for your Input and Output, including any public performance or distribution of generated content.
6.2 Indemnification
You agree to indemnify and hold TuneScript harmless against any claims, losses, damages, or expenses arising from:
- Your use of TuneScript,
- Any Output that infringes third-party rights, or
- Violation of these Terms or applicable law.
6.3 Limitation of Liability
- To the maximum extent permitted by law, TuneScript and its affiliates are not liable for indirect, incidental, or consequential damages, loss of profits or business, or any claims arising from your generated content.
7. Copyright Compliance
- TuneScript AI is designed to produce original content.
- Users must not prompt the AI to copy or imitate copyrighted works.
- TuneScript retains the right to monitor, remove, or refuse content that may infringe on third-party rights.
8. Accounts and Security
- You must create an account to access TuneScript.
- You are responsible for safeguarding your account credentials.
- You are responsible for all activity under your account.
- Unauthorized access or sharing of accounts is prohibited.
9. Termination
- TuneScript may suspend or terminate your account if you violate these Terms, your use poses legal or security risks, or termination is required by law.
- Upon termination, your access to the service will end, and TuneScript may delete your content after 30 days.
10. Privacy
- TuneScript collects and processes personal data according to our Privacy Policy. By using TuneScript, you consent to this processing.
11. Changes to Terms
- TuneScript may update these Terms at any time. Continued use of the service constitutes acceptance of updated Terms.
12. Governing Law
- These Terms are governed by the laws of the United States (or your jurisdiction). Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in your location.
13. Acknowledgment
By using TuneScript, you acknowledge that:
- You understand and accept these Terms.
- You are responsible for all legal and copyright obligations arising from generated content.
- TuneScript provides tools and guardrails but does not guarantee immunity from copyright claims.
